Worker injured when a large piece of metal equipment fell from a truck and struck him in the head. He sustained multiple injuries including a concussion and a disc extrusion in the lumbar spine displacing the S1 nerve root. He also fractured several teeth in the incident and was diagnosed with myalgia/myositis. The injured client required back surgery, consisting of lumbar decompression and discectomy.
The defendant denied liability, arguing that its employees did not improperly unload the equipment which fell on our client. The case settled after private mediation, in conjunction with a settlement of the underlying workers’ compensation claim. As part of the settlement, the workers’ compensation insurance carrier waived its lien (which exceeded $100,000.00) in the third party case.
